Okay, I change my vote to "Yes" Matt.  

I just wanted to make sure that I understood the rationalization behind
making fatal and error potentially the same for some implementations.
My understanding now, albeit vague, is that upon seeing a "fatal" the
state of any particular elaboration may be different and thus it would
be difficult to make things compliant.
