P1800-2005 12.4.2 is clear:
   It shall be illegal to use argument passing by reference for
   subroutines with a lifetime of static.

If you are talking about the example in 12.4.2, I agree that
it should be cleaned up to be clear.

One could argue that the LRM is silent about the context
of the example -- such a declaration would be legal in a context
that defaults to automatic.  But that is a bit subtle and for
examples like this the LRM should be clear.

BTW, please do indicate sections numbers if you think there is
an example or text issue.
